1. About PIVOT

PIVOT is a Canadian online marketplace facilitating the listing, discovery, and connection of buyers and sellers of businesses. PIVOT is not a broker, agent, or party to any transaction. We do not verify the accuracy of listings unless explicitly marked as "Verified." All transactions occur directly between buyers and sellers.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into contracts in your jurisdiction to use PIVOT. By creating an account, you represent that you meet these requirements.

3. Listings

Listings are posted immediately upon submission. You are solely responsible for the accuracy of your listing. PIVOT reserves the right to remove any listing at our sole discretion, including those that are inaccurate, misleading, inappropriate, or otherwise in violation of these Terms. You may remove your own listing at any time from your account dashboard.

Prohibited listings include: fraudulent businesses, pyramid schemes, businesses requiring illegal activity, sexually explicit services, and businesses primarily intended to facilitate scams or money laundering.

4. No Fees

Listing on PIVOT is free. We do not charge listing fees, success fees, or commissions. We reserve the right to introduce optional paid features in the future with advance notice.

5. No Warranties

PIVOT is provided "as is" without warranties of any kind, express or implied. We do not warrant that listings are accurate, complete, or lawful. Buyers should conduct their own due diligence, including obtaining legal and financial advice, before entering any transaction.

6. Limitation of Liability

To the fullest extent permitted by applicable Canadian law, PIVOT shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the platform, including any transaction between a buyer and seller discovered through PIVOT.

7. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

1. Information We Collect

When you create an account, we collect your name and email address. When you post a listing, we collect the business information you provide. We also collect standard usage data (pages visited, time on site) to improve the platform.

2. How We Use Your Information

We use your information to operate the platform, facilitate connections between buyers and sellers, send transactional emails (e.g. listing confirmation), and improve our services. We do not sell your personal information to third parties.

3. Listing Visibility

Information you include in a public listing — including business description, location, and financial summaries — is visible to all visitors of PIVOT. Do not include personally identifying information (e.g. your name, phone number) in your listing description unless you intend it to be public.

4. Cookies & Local Storage

PIVOT uses browser local storage to cache news images and save your integration settings. No third-party tracking cookies are placed without your consent. We do not run advertising on this platform.

5. PIPEDA Compliance

We comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). You have the right to access, correct, or request deletion of your personal information. To exercise these rights, contact us at privacy@pivotexchange.ca.

6. Data Retention

We retain your account information for as long as your account is active. Listings removed by you or by PIVOT are deleted from public view immediately but may be retained in server logs for up to 90 days.
